i-THRIV Wellness, Delivered – Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and i-thriv Wellness, Delivered ("i-thriv," "we," "us," or "our"). By accessing or using our services, including our website, mobile application, and in-person wellness offerings (collectively, the "Service"), you acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

1. Eligibility and Account Registration

  • You must be at least 18 years old to use the Service or book for another individual.

  • If booking for a minor, a parent or legal guardian must be present during the session.

  • You agree to provide accurate, complete, and up-to-date information when registering or booking.

  • i-thriv reserves the right to suspend or terminate your access if information is found to be false or misleading.

2. Services Provided

i-thriv connects users with licensed wellness professionals, including massage therapists, estheticians, yoga instructors, and sound bath providers ("Providers"). Services are delivered at homes, offices, hotels, and vacation rentals across our designated service areas.

3. Independent Contractor Acknowledgment

All Providers operate as independent contractors. i-thriv does not employ Providers and is not responsible for any claims, injuries, damages, or liabilities that arise out of or relate to services performed by a Provider.

4. Payment, Pricing & Cancellation

  • Payment is due upon booking through our website or mobile application.

  • Prices may vary based on location, service type, and session length.

  • You authorize i-thriv to charge your selected payment method for services rendered.

  • Cancellations within 24 hours of your scheduled service may result in a cancellation fee.

5. Refunds

All sales are final. Refunds will only be issued at i-thriv’s sole discretion. If a Provider ends a session early due to inappropriate behavior or safety concerns, no refund will be granted.

6. Conduct and Safety

  • All users and providers must treat one another with respect and professionalism.

  • Inappropriate behavior—including but not limited to sexual advances, harassment, discrimination, or threatening conduct—will result in immediate termination of the session and may lead to removal from the platform.

  • i-THRIV reserves the right to investigate and report such incidents to law enforcement or appropriate regulatory bodies.

  • i-thriv reserves the right to report such incidents to law enforcement.

7. Medical Disclaimer

  • i-thriv services are for wellness and relaxation purposes only.

  • We do not diagnose, treat, or cure medical conditions.

  • You are responsible for consulting a physician before receiving any wellness treatment.

  • If you are experiencing a medical emergency, call 911 immediately.

8. Use of Platform

You agree not to:

  • Rebook Providers outside the i-thriv platform.

  • Reverse engineer, copy, or disrupt the platform’s functionality.

  • Post false, defamatory, or abusive content.

  • Violate any applicable local, state, or federal laws.

9. Privacy and Communications

  • By using the Service, you consent to receive transactional emails and text messages.

  • You may opt out of promotional messaging at any time.

  • Personal data is handled according to our Privacy Policy.

10. Dispute Resolution and Arbitration

  • Any disputes shall be resolved through binding arbitration on an individual basis.

  • You waive your right to a jury trial or to participate in class actions.

  • Arbitration will be governed by the American Arbitration Association rules.

11. Limitation of Liability

To the maximum extent permitted by law:

  • i-thriv will not be liable for indirect, incidental, or consequential damages.

  • Our total liability shall not exceed the amount you paid for the service in question.

12. Modifications to Terms

i-thriv may revise these Terms at any time. Continued use of the Service after changes are posted constitutes your acceptance of the updated Terms.

13. Termination

i-thriv may terminate or suspend access to the Service at any time, with or without cause, and without prior notice.

14. Governing Law

These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles.
